Reasonable accommodations under ADA explored
Nemeth Burwell's Raising the Bar, an educational series raising employer awareness of current issues in employment and labor law and presented by employment law firm Nemeth Burwell PC, will present "Mastering the Interactive Process: Putting the Reasonable Back in Accommodation" on Thursday, Sept. 20, in Troy.
Nemeth Burwell attorneys will discuss issues regarding ability to work, legally required time-off to accommodate a disability, and the various interpretations of reasonable accommodations under the Americans with Disabilities Act Amendments Act (ADAAA).
"Congress expanded the definition of disability under the Americans with Disabilities Act (ADA) with the ADAAA in 2008 and the EEOC recently implemented new enforcement initiatives designed to eradicate disability discrimination in the workplace. Combined, these efforts are making it increasingly difficult for employers to understand the definition of disability and the scope of accommodation required in the workplace," explains Nemeth Burwell attorney Patricia Nemeth.
Topics for the presentation on ADA/ADAAA include:
* Who must be accommodated?
* What triggers the requirement for employer and employee to engage in the interactive process?
* When is a leave of absence a reasonable accommodation?
* How is the ADA coordinated with short and long-term disability leaves, FMLA leaves and Workers' Compensation leaves?
* How do employers maintain production and performance standards in light of an accommodation request?
Raising the Bar will be conducted Thursday, Sept. 20, from 8:30 a.m. until 11:30 a.m. at the Troy Marriott, 200 W. Big Beaver Road. Continental breakfast will be served at 8 a.m.
