The Oakland County Bar Association’s Energy, Sustainability and Environmental Law Committee along with the OCBA’s Real Estate Committee presented “Avoiding the Abyss:?Environmental Due Diligence in Real Estate” on Wednesday, June 15, at Western Michigan University Cooley Law School’s Auburn Hills campus. Moderator Philip Grashoff (far right), of Kotz, Sangster, Wysocki PC, happily presented speakers (left to right) Nicholas Maloof, Brian Considine, and David Michael. Maloof, president and general counsel of Associated Environmental Services LLC, discussed assessing the environmental condition of real property though ASTM Phase I and Phase II environmental assessments, natural resource assessments, and hazardous building material surveys and environmental insurance. Considine, of Dawda Mann, Counselors at Law, covered the legal liabilities and risks associated with the sale and purchase of brownfields or properties with other environmental issues such as wetlands or endangered species. Michael, of Lipson, Neilson, Cole, Seltzer, & Garin PC, taught attendees how to draft transactional documents to minimize environmental liabilities and spread risk. “We are combining the real estate lawyer with the environmental lawyer with a consultant talking all about the issues surrounding environmental due diligence on the acquisition of real estate in Michigan now—all the pitfalls and deep crevices and some of the new laws that are coming down the pike,” Grashoff noted.
