Woman who tripped in road wins key ruling from Michigan high court

LINCOLN PARK, Mich. (AP) — A woman who was injured when she tripped on an elevated slab of concrete in suburban Detroit has won a key decision from the Michigan Supreme Court.

The court unanimously said Barbara Kozak had presented enough evidence to counter Lincoln Park’s argument that Kings Highway was safe and in reasonable repair. There was a 3-inch difference in elevation between two slabs.

A Wayne County judge had ruled in favor of Lincoln Park and dismissed the lawsuit. But the Supreme Court says the city relied on an affidavit from a city employee who said the highway was fine.

A resident said the road had been defective for about six years. The case now returns to Wayne County.
