Man found guilty on all eight charges in criminal sexual conduct case

Following a three day trial, a Macomb County jury took just 40 minutes to convict Charles Wayne Francisco of all eight charges in a Criminal Sexual Conduct case involving a victim he assaulted over a five year period.
The victim was sexually and physically assaulted by her mother’s boyfriend from the time she was six years old until she was 11. The defendant was charged and arraigned for the crimes.  While on bond the defendant cut off his GPS tether and absconded for three and a half months. The defendant was previously convicted in 2004 of Attempted Criminal Sexual Conduct in the Third Degree.  Francisco is a habitual fourth offender and is facing a mandatory minimum sentence of 25 years in the Macomb Department of Corrections, and a mandatory lifetime tether.

On March 22, the defendant was found guilty of three counts of Criminal Sexual Conduct First Degree with a victim under 13, defendant 17 or older (life felony,)  Criminal Sexual Conduct Second Degree with a victim under 13 years old  (15 year felony,) Absconding (four year felony,) Tampering with an electronic monitoring device (two year felony,) Aggravated Indecent Exposure (two year high court misdemeanor,) and Domestic Violence (93 day misdemeanor).

Francisco will be sentenced on Wednesday, April 26, 9 a.m. in front of Macomb County Circuit Court Judge Julie Gatti.

“Thank you to the Warren Police Department for their commitment in investigating this matter. This type of behavior has absolutely no place in a civilized society and will be prosecuted to the fullest extent in Macomb County,” said Macomb County Prosecutor Peter J. Lucido.
