'Daubert, Frye, and Expert Witness Challenges' examined

American Law Institute Continuing Legal Education will present a webcast on “Daubert, Frye, and Expert Witness Challenges” on Tuesday, August 22, from noon to 1:15 p.m.

The success or failure of a case may rely on a battle of the experts. If an expert is admitted, an attorney is one step closer to winning but if the expert is excluded it may mean the attorney already lost.  In many instances, an expert challenge might be the most significant issue in a case. Expert challenges are rife with pitfalls and are further complicated by the evolving Daubert/Frye caselaw that governs the admissibility of opinions and expert testimony.

During the webcast, an experienced litigator will cover why, when, and how to execute (or defend) an expert challenge using product defect, construction defect, and personal injury illustrations that will focus on the factors that are most relevant to each type of case. Presentation time will also include a narrative of best practices for preparing a witnesses for, and examining an adversary’s witnesses at depositions and
Daubert hearings. Other topics of discussion include:

• The applicability of the Daubert/Frye standards to the presentation of expert testimony
  - Frye standards: How they differ from Daubert standards
  - Preparing dispositive motions

• What is required to successfully raise or defend a challenge to the admission of expert testimony
  - When, how, and why to challenge experts
  - Under what circumstances should counsel consider not filing a Daubert/Frye motion?

• Expert witness best practices: Preparing to challenge the opposing party’s expert and preparing your own expert to withstand a challenge

• Lessons learned from court rulings, and how to leverage prior rulings to advance or refute your expert challenge
