Navigating government construction tops agenda at ABA Construction Law meeting in D.C.

Leading construction lawyers, industry leaders and experts will discuss navigating the government construction claims and procedure process; delay, disruption and pricing of claims; green and sustainable spending; cybersecurity threats; and termination of projects at an American Bar Association Forum on Construction Law meeting on September 27-29 in Washington, D.C.
Program sessions include:

• “Adventures in Federal Construction: Traps for the Unwary” — This session will help lawyers understand the core concepts, strategies and developments involved with federal projects. The panel will discuss pitfalls associated with the False Claims Act, Buy American Act, Davis-Bacon Act, Christian Doctrine and performance evaluations.

• “The Greening of Construction: Exploring Sustainability” — Panelists will discuss the recent green construction and sustainability legislation, rules and regulations of the federal government.

• “Cybersecurity: The Evolving Threats and Obligations for Government Projects” — Panelists will discuss the growing threats posed by cyber criminals, which have reshaped how business and government function. Cybersecurity topics for discussion include the regulations embedded in the Federal Acquisition Regulations, the Cyber Security Maturity Model Certification (CMMC), Controlled Unclassified Information (CUI) and Secure Software Development Framework (SSDF) in addition to regulations in subcontract requirements, cyber insurance and enforcement.

• “Ethics of Litigation for Construction Attorneys” — Thomas E. Spahn of McGuireWoods LLP will lead an interactive program using hypotheticals to explore litigation ethics scenarios that face commercial and government construction litigation.

• “Diversity and Inclusion Breakfast” — Bob Kendrick, president of the Negro Leagues Baseball Museum in Kansas City, Missouri, and host of the Black Diamonds podcast, will speak on issues related to sports, race and diversity.
