Kilpatrick must pay restitution, judge says

By Ed White Associated Press Writer DETROIT (AP) -- Former Mayor Kwame Kilpatrick failed to stop a court order Tuesday that requires him to make two large payments toward his $1 million restitution to Detroit, including $79,000 due this week. Kilpatrick claims he can't afford it. But Wayne County Circuit Judge David Groner refused to reconsider his Jan. 20 decision or suspend it while an appeal is pursued. Groner rejected arguments that he violated Michigan law with the revised plan, which followed six days of testimony about the Kilpatrick family's finances. Kilpatrick must come up with $79,000 by Friday and $240,000 by April 20. The judge last month agreed with prosecutors that the ex-mayor had not been honest about his finances. In 2008, Kilpatrick pleaded guilty to obstruction of justice, served 99 days in jail and agreed to pay $1 million to Detroit for lying in a civil trial. He's making monthly payments of $3,000 while living in the Dallas area and working as a salesman for Covisint. But prosecutors learned Kilpatrick and his wife have had other money, including $240,000 in loans, live in a rented mansion and drive fancy SUVs. Prosecutor Kym Worthy declined to comment on the latest legal development. A message seeking comment was left with Kilpatrick's attorney, Daniel Hajji. He told WDIV-TV that Kilpatrick has "suffered enough." Published: Thu, Feb 18, 2010
