News (AP) - Court rules against mom in drowning case

TROY (AP) -- A woman who sued her ex-husband after their daughter drowned at a graduation party in Oakland County has lost her case at the Michigan Court of Appeals. In a 2-1 decision, the appeals court says there's no evidence Daniel Wilson willingly put his daughter at risk. Jordyn was 3 1/2 years old when she drowned at a lake in Troy. Wilson briefly left the beach to use a bathroom and believed there were other adults around. His ex-wife, Nicole Mickel, filed a lawsuit in Oakland County in 2007 as representative of their daughter's estate. The appeals court on Wednesday upheld a lower court decision in favor of the father. Judge Elizabeth Gleicher disagreed, saying a jury should decide the case. Published: Fri, Sep 3, 2010
