Firm presents seminar on worker classification
Nemeth Burwell's Raising the Bar, an educational series raising employer awareness of current issues in employment and labor law and presented by Detroit-based employment law firm Nemeth Burwell PC, will address the complexities involved in classifying workers at its Wednesday, Sept. 29, seminar titled "Independent Contractor or Employee? A Wrong Guess Could Be Costly."
Nemeth Burwell attorney and seminar presenter Susan Koval says that liability exposure can be substantial if an employer is found to have misclassified an employee.
"Independent contractors, consultants, and contingent workers are being used more frequently by employers as they try to meet tighter budget guidelines," says Koval. "As a result, the Department of Labor, the IRS and a number of state agencies are questioning the classification of workers in every type of industry. No category of worker has been ignored, from exotic dancers to physicians," she explains.
Seminar topics will include:
* Applicable laws and legal standards for classifying workers.
* Pending legislation.
* Recent court decisions.
* Legal trends--"They have us surrounded."
* Legal consequences of misclassifying workers.
* Liability as a joint or co-employer with a staffing company or referral agency.
* Recommendations and best practices to avoid liability, including the five most important provisions to include in contracts with non-employees.
The seminar will be conducted Wednesday, Sept. 29, from 8:30 a.m. until 10:30 a.m. at the Troy Marriott, 200 W. Big Beaver Road. Continental breakfast will be served at 8 a.m. The cost of the event is $60 per person and pre-registration is required by Friday, Sept. 24.
