Appeal spiked; teacher can't be fired for lewd act

HARRISON TOWNSHIP, Mich. (AP) -- The Michigan Supreme Court won't get involved in a dispute between a school district and a teacher who was photographed simulating sex acts on a mannequin at a boat party.

The court's decision to sit it out Wednesday means the L'Anse Creuse district in Macomb County can't fire Anna Land.

The middle school teacher was fired in 2007 but the state Tenure Commission and the Michigan appeals court overturned that ruling. In May, the appeals court said Land's conduct was "coarse" but not illegal and not inappropriate for an adult event.

The pictures were taken without Land's knowledge in 2005 and posted on a website two years later.
