DETROIT (AP) -- A Wayne County Circuit judge has dismissed a case against a former Detroit Public Schools principal accused of having the school pay for a furnace for her home, and not paying for items from a school boutique.
The Detroit Free Press reported that prosecutors plan to appeal Judge Michael Callahan's ruling.
Embezzlement charges were announced in August against Gwendolyn Miller who had worked at Randolph Career and Technical Center.
Defense lawyer Elliot Hall has said Miller paid for the boutique items and was unaware the school was billed for the furnace.
The Associated Press left a message Tuesday seeking comment from Hall.
Prosecutors say the boutique payments came after the items were taken, and the district was repaid for the furnace only after Miller was confronted by investigators.
