‘Business Valuation in Litigation’ focus of webcast

American Law Institute Continuing Legal Education will present the webcast “Business Valuation in Litigation: 10 Things You Need to Know” on Wednesday, November 29, from noon to 1 p.m.
A partner or shareholder dispute can be costly and time consuming, especially if it ends up in court. If the falling-out escalates to this level, much of the litigation will revolve around a detailed valuation of the business. As counsel, attorneys must have an understanding what factors must be considered when determining the true value of the business, as well as how to select an experienced appraiser that can skillfully prepare testimony to present in court.
Valuation of a company for litigation purposes is more than a numbers games. Every report must provide a complete and accurate financial profile that is as unique as the company it represents and, most importantly, will hold up under scrutiny in court.
This 60-minute webcast will break down important business valuation reporting standards in the context of partnership disputes that have devolved into litigation.
The webcast faculty will discuss:
• Why valuation in a business dispute is not only about the numbers
• Why wide variations in assessments sometimes occur – even by the valuers
• Best practices to involve the expert early and broadly in case strategy
• How the process of valuation may lead to other issues
• An overview of methodologies
• Factoring in factors beyond the numbers – valuing how a company works

• Why the right expert may help to prevent expensive litigation in a business divorce
• How to vet the right expert for your case

License renewal deadline for Michigan attorneys approaching

The deadline for the 2023-2024 Michigan law license renewal process is fast approaching. Payment must be received or postmarked by the post office by Thursday, November 30, to avoid a $50 late fee.

As a reminder, this year’s license renewal includes new requirements for private practice attorneys to ensure compliance with Rule 21: Mandatory Interim Administrator Planning, which requires private practice attorneys to make an interim administrator plan and name a person with knowledge of their practice. Private practice attorneys should review these requirements at?michbar.org/Rule21?prior to beginning their license renewal.

Ninetieth Annual Winter Gala hosted by IABAM

The Italian American Bar Association of Michigan will host its Ninetieth Annual Winter Gala benefitting Friends of Foster Kids on Friday, December 1, beginning at 6 p.m.
The black tie optional event will take place at Highlands Renaissance Center in Detroit and feature hor d’oeuvres, cocktails, dinner, dessert, presentation of awards, and live music by Fantasia.

The Jewish Bar Association of Michigan (JBAM) will host a Hanukkah Party on Tuesday, December 5.
The celebration will take place from 5:30 to 8 p.m. at Urbanrest Brewing Company located at 2615 Wolcott St. in Ferndale. Light appetizers and a drink ticket are included for attendees.

‘Friend of the Court Alternative Dispute Resolution Training’ offered online
December 5-7, 12-13
The Michigan Judicial Institute (MJI) and Friend of the Court Bureau (FOCB) will present the “Friend of the Court Alternative Dispute Resolution Training” online Tuesday through Thursday, December 5-7, and Tuesday and Wednesday, December 12-13, from 9 a.m. to 3 p.m. each day via Zoom.
MCR 3.224 provides that the State Court Administrative Office (SCAO) will establish training and qualification requirements for persons conducting each type of alternative dispute resolution activity.
This virtual 20-hour training meets SCAO’s training requirements for friend of the court staff to conduct facilitative and information-gathering conferences and friend of the court domestic relations mediation.
Due to the interactivity of the webinar, participation will be limited to no more than 24 participants. MJI will ensure that as many courts are included in the training as possible. By registering for this webinar, staff is committed and required to attend all sessions. If there is any reason staff members cannot attend all sessions, they should not register.

‘Problem-Solving Courts’ virtual training offered
December 6
The Michigan Judicial Institute and Problem-Solving Courts (PSC) will conduct a “Fundamentals of Problem-Solving Courts” virtual program on Wednesday, December 6.
This collaborative training presented by SCAO and the Michigan Association of Treatment Court Professionals (MATCP) will focus on the fundamentals of a successful problem-solving court. This training is ideal for new problem-solving court teams and team members, is recommended for more-experienced team members who want a refresher, and is required for judges and coordinators of programs receiving first-year funding through any SCAO problem-solving court grant program. This training will be held virtually via Zoom.

Attorney gives ‘Update on the State of Criminal Law’

The Oakland County Bar Association will present “Update on the State of Criminal Law 2023 Part Two” as a webinar online Tuesday, December 12, from 11:30 a.m. to 1 p.m. via Zoom.
This webinar will provide an overview of the most recent published Michigan Court of Appeals and Supreme Court cases with a focus on sentencing decisions. It will also review the most important decisions from the United States Supreme Court. Speaking at the webinar will be Alona Sharon, of Alona Sharon PC.
Credit has been approved with the OCBA for 1.50 Criminal credits and 1.50 Juvenile credits.
Cost for the webinar is $12 for OCBA members pre-registration and $25 for non-members pre-registration. Oakland County MIDC court appointed attorneys can attend for free.

‘Problem-Solving Courts Certification’ explored

The Michigan Judicial Institute and Problem-Solving Courts (PSC) will conduct a “Problem-Solving Courts Certification Process” virtual program on Wednesday, December 13, via Zoom.
This training will provide a comprehensive overview of the PSC certification process, what is required to achieve certification, and the certification site visit process. This training is intended for coordinators and other leaders of adult problem-solving courts, especially those who have a certification site visit in 2024.

Maribeth Graff of the Michigan Board of Law Examiners will lead a succinct overview of the steps required to swear in a Michigan attorney and ways to ensure a candidate is not a fraudulent one. She will answer such questions as:

• What needs to happen if I’m asked to swear in a new attorney candidate?

CAP Seminar Schedule
The 2016 CAP Seminars began on August 26. To accommodate the busy schedules of the court and members of bar, the seminar schedule this year includes the CAP Make-Up Seminars that are now scheduled on the alternate weeks of the CAP Live Seminars. Attorneys will only receive credit for attending a make-up seminar topic they did not already attend as a live seminar. Live seminars will be held in the Erma Henderson auditorium located on the 13th Floor of the Coleman A. Young Municipal Center (CAYMC), and the make-up seminars will be held in the Jury Assembly Room located at the Frank Murphy Hall of Justice (FMHJ). Each seminar will begin at 1:30 p.m. Note, out of courtesy to the speakers and attendees, late registrations will not be permitted beyond 1:45 p.m. Attorneys arriving after 1:45 p.m. will not receive credit for the session.
