Muskegon County Services working together to 'Help Someone Start Over'

“Help Someone to Start Over” is an example of Muskegon County Services working together. Under the direction of Muskegon County Public Defender Frederick D. Johnson Jr., and Muskegon County Clerk Nancy A. Waters, the program has been developed to locate persons eligible for a felony set-aside.

They are asking for help in finding those eligible for a felony set-aside. Setting aside a felony charge can help those held accountable for a crime get their lives back on track. If five years have passed since the conviction or release from imprisonment, one may be eligible for a set-aside (see checklist below for restrictions).

Why set aside a felony charge? With a clean record it is easier to get a job, get a loan, adopt, get educational opportunities, volunteer, and more.  Help better someone’s life and our community today.

If all the questions below can be answered with a “No,” the individual may be eligible to have his or her conviction set aside. Those who are unsure if they are eligible should consult an attorney. Felony Set-aside (Ex-pungement) Eligibility Checklist:

Do you have a criminal conviction from a federal court?

Do you have a criminal conviction in another state?

Do you have another adult criminal conviction in Michigan (excluding those for which judgment of guilt was deferred and excluding up to two minor offenses)?

Were you convicted of a felony or an attempt to commit a felony for which the maximum punishment is life imprisonment?

Were you convicted of felony criminal sexual conduct or assault with intent to commit criminal sexual conduct?

If the conviction you want to have set aside a misdemeanor or felony traffic offense?

Has it been less than five years since the date of your conviction, or if you were imprisoned, has it been less than five years since you were released?
