The Oakland County Bar Association’s Municipal, Real Estate, and Energy, Sustainability and Environmental Law Committees will present a webinar on “F.P. Development v Canton: Uprooting local municipal ordinances” on Thursday, January 13, from 8:30 to 10 a.m. via Zoom.
A recent Federal Sixth Circuit case, F. P. Development, LLC v Charter Township of Canton, Michigan, invalidated Canton’s tree ordinance, deeming it an unconstitutional taking. The decision raises broader questions since the ordinance is very similar to other municipality tree ordinances. It raises broader questions about how opponents of local ordinances may challenge those ordinances and what municipalities should do to make their ordinances less prone to successful challenges.
Topics of discussion will include:
• The legal standards of review for challenges to local ordinances
• Regulatory takings
• How to support a challenge to a local real estate regulatory ordinances
• What municipalities should do in adopting their ordinances to make them more defensible against such challenges.
