Appointments

1. 2010-01 Subject: Appointment to the Attorney Grievance Commission.

Issue: Discussion regarding appointment of candidate to the Attorney Grievance Commission to replace layperson Deborah Butler.

Status: Awaiting conference consideration.

2. 2010-01 Subject: Appointments to the Committee on Model Civil Jury Instructions.

Issue: Whether to reappoint current members who are eligible for reappointment to the Committee on Model Civil Jury Instructions (including Hon. Alfred M. Butzbaugh, Elizabeth Phelps Hardy, Paul C. Smith, and Hon. Jane M. Beckering), and whether to appoint Judge Butzbaugh as chairman. In addition, the Court may consider candidates to replace outgoing members Mary Massaron-Ross, Mark Granzotto, and Hon. William Giovan.

3. 2010-01 Subject: Appointment of Chief Judge in the 48th Circuit Court.

Issue: Whether to appoint Circuit Judge-Elect Margaret Bakker as chief judge to fill the vacancy created upon the

completion of Chief Judge George R. Corsiglia's term of office, which will terminate at the end of this year.

4. 2002-37 Subject: Proposed E-filing Administrative Order in Macomb County.

Issue: Whether to approve the e-filing administrative order for Macomb County.

Status: Awaiting conference consideration.

5. 2005-14 Subject: Proposed Amendment of Rule 3.207 of the 2007-29 Michigan Court Rules.

Issue: Whether to publish for comment a proposed amendment of MCR 3.207 and a proposed uniform property restraining order as submitted by the Family Law Section of the State Bar of Michigan.

Status: Awaiting conference consideration.

6. 2008-18 Subject: Proposed Amendment of Rule 3.501 of the Michigan Court Rules (Hill v City of Warren, 480 Mich 1195 [2008])

Issue: Whether to amend MCR 3.501(B) to create an explicit requirement that a change in circumstances must have occurred to allow a party to file a supplemental motion for certification of a class, and the motion must be filed within 21 days of the party's knowledge of the changed circumstances.

Status: Passed from 11/17/10 conference.

7. 2008-28 Subject: Proposed Amendment of Rule 6.005(H)(3) of the Michigan Court rules (People v Murphy, 1/Nov 07)

Issue: Whether to amend MCR 6.005(H)(3) to require that, when responding to a prosecutor's interlocutory appeal, defense counsel shall either file a substantive brief or communicate to the Court of Appeals that s/he will not be filing a brief in response to the application.

8. 2009-20 Subject: Proposed Amendments of Rule 3 and Rule 5 of the Rules of the Board of Law Examiners

Issue: Whether to publish for comment a proposed amendment submitted by the State Bar of Michigan that would clarify that a former member of the Michigan bar who resigned may apply for readmission without examination under BLE Rule 5 if the former member meets the rule's requirements.

9. 2009-24 Subject: Discrepancies in Civil and Criminal Law Regarding Venue (see People v Hoothoofd, 487 Mich 568 [2010]).

Issue: Should legislative action be recommended or a proposed court rule amendment published to resolve procedures related to challenges of improper venue, particularly in a criminal case?

Status: Awaiting conference consideration.

10. 2009-25 Subject: Amendment of Rule 8.120 of the Michigan Court Rules.

Issue: Consideration of the recent amendment of MCR 8.120 in light of receipt of Dean Howarth's letter, and application of the requirement for written consent from an indigent person.

Status: Awaiting conference consideration.

11. 2009-29 Subject: Proposed Amendment of Rule 5.306 of the Michigan Court Rules

Issue: Whether to publish for comment a proposed amendment of MCR 5.306 that would eliminate the requirement to include the decedent's last known street address from the information contained on the notice to creditors.

Status: Awaiting conference consideration.

12. 2010-05 Subject: Proposed Revision of MCR 2.112 and MCR 7.206

Issue: Whether to publish for comment several rule amendments suggested by the Legislative Commission on Statutory Mandates related to Headlee actions.
